Scott Lilly is a Christchurch-based builder who was fined US$3,000 recently by the Building Practitioner’s Board. The Building Practitioner’s Board determined that Lilly had switched a roofing material consented to with a Chinese counterpart cheaper without permission. The roof’s coating started to fade a few years after the problem became apparent. It’s believed that 60 homes were constructed using the product. After initially denying that he had any connection with the material’s supply, he claimed the product was in compliance with New Zealand Building Code. But there was no concrete proof of this.

Selwyn District Council received a complaint from the buyer after he noticed that the roof paint was starting to deteriorate. Unaware that Zibo Wangshun Building Materials Company had substituted the MetalCraft-approved product, the Selwyn District Council issued a Code of Compliance to the home. Lilly didn’t respond to questions about the house but admitted that his firm provided it later.

The board found that Lilly was reckless and dangerous in her approach to the consenting procedure, which exceeded negligence. As a result, the Building Act has been compromised. Lilly appeared before the Building Act Board twice. In 2015, she was found guilty of violating consent in the same way. She received a fine of $2,000 and was convicted.

The board noted that an Excel spreadsheet was sent to them with possible locations where other houses may have replaced their roofs using the same Chinese material. Lilly stated the materials were used for “some existing (at that time) homes being constructed,” however he didn’t specify how many houses and said he stopped using the material because of shipping.
